Terkai

Terms and conditions

1. Eligibility and agreement

You must be at least 18 years old to open or use a workout plan. By selecting “I agree to the Terms and Conditions,” you confirm that you meet this age requirement, have read these terms, and agree to them. If you are under 18 or do not agree, do not open or use a plan.

You must provide accurate and reasonably complete information about your training experience, schedule, available equipment, goals, and relevant restrictions. Generate a plan only for yourself and use an email address that you control.

Terkai's current generator is not designed to create individually assessed programs for people with injuries, medical conditions, significant pain, rehabilitation requirements, or other circumstances requiring personalised professional supervision. If any of these apply to you, do not rely on a generated plan without first obtaining appropriate professional advice.

2. What Terkai provides

Terkai produces a one-week muscle-building plan from your selections and an exercise library. It includes suggested exercises, sets, repetitions, rest periods, and effort targets. The session length you select is a time budget, not a promise of an exact workout duration.

The current plan is free. Opening it does not create a paid subscription or a password-based account. Any future paid service would require separate information and agreement before you are charged.

3. Automated guidance and its limits

Terkai generates automated fitness guidance based on the information you provide and the information available to the service.

A generated plan is not individually reviewed by a doctor, physiotherapist, accredited exercise professional, personal trainer, or other healthcare professional unless Terkai expressly states otherwise.

Terkai does not provide medical advice, diagnosis, treatment, rehabilitation, or healthcare services. Generating or using a plan does not create a clinician-patient, trainer-client, or other professional relationship.

Terkai cannot examine you, observe your movement or technique, inspect your equipment or training environment, assess every health condition, detect pain or fatigue, or continuously monitor how you respond to training.

Automated recommendations can contain errors, omissions, or recommendations that are not appropriate for your circumstances. You should review each exercise and session before performing it and use your own judgment about whether it is suitable for you.

No particular muscle gain, strength increase, performance improvement, body-composition change, or other result is promised or guaranteed.

4. Exercise risks and your responsibilities

Resistance training and physical exercise involve inherent risks. These can include soreness, strains, sprains, falls, equipment-related injuries, aggravation of existing conditions, serious physical injury and, in rare circumstances, death.

By choosing to follow a Terkai plan, you acknowledge these risks and understand that Terkai cannot eliminate them.

You are responsible for deciding whether you can safely perform a particular exercise or workout and for making decisions within your control, including:

Do not perform an exercise merely because it appears in your generated plan if you believe it may be unsafe or inappropriate for you.

Use appropriate equipment and controlled technique and obtain qualified instruction or supervision where needed.

If you have an injury, health condition, significant physical limitation, or concerns about exercising safely, obtain advice from an appropriately qualified professional before following a generated plan.

Stop exercising and seek appropriate assistance if you experience severe, unusual, or concerning pain or symptoms. Terkai is not an emergency or medical service.

Nothing in this section removes any duty or responsibility that applicable law places on Terkai.

5. Opening, saving, and returning to your plan

You enter your email address to open your generated plan and download its PDF. In the live service, Terkai also sends a private link to that address. Your plan and newly issued links remain available until 30 days after you first open the plan. The expiry date is shown with the plan. An unopened generated plan expires after 24 hours.

You can reuse your email link on another device while the plan remains available. Anyone with the link can open the plan, so keep it private and take care on shared devices. If you lose the email, use “Already built a plan?” on the website to request a link to your latest unexpired plan.

Requesting or using another link does not extend the original expiry date. Email delivery can be delayed or fail. Download the PDF if you want to retain a copy after online access expires. A downloaded copy is not updated automatically.

When the website identifies itself as a local preview, plans and email requests are stored on that computer and no email is sent.

6. Permitted use and service availability

You may view and download your plan for personal use. Do not attempt to access someone else’s plan without permission, bypass access controls, disrupt the service, or use it unlawfully.

Access may be temporarily interrupted by maintenance, faults, or events outside reasonable control. Access may be restricted where reasonably necessary to address misuse or protect the service and its users. These provisions do not remove rights or remedies you have under applicable law.

7. Disclaimers and limitations of liability

Your statutory rights

Every exclusion and limitation in these terms applies only to the maximum extent permitted by applicable law.

Nothing in these terms excludes, restricts, or modifies any consumer guarantee, statutory right, remedy, duty, or liability that cannot lawfully be excluded, restricted, or modified, including rights that may apply under the Australian Consumer Law.

Terkai parties

In this section, “Terkai parties” means the operator of Terkai and, where applicable, its officers, employees, developers, contractors, and content contributors acting in connection with the service.

Automated recommendations

To the maximum extent permitted by law, Terkai does not guarantee that:

Plans and PDFs are automated fitness guidance and do not replace appropriate professional assessment, medical advice, or supervised training.

Matters within your control

To the maximum extent permitted by law, the Terkai parties are not responsible for loss, injury, or damage to the extent it results from matters outside Terkai's reasonable control, including:

This does not exclude liability to the extent that Terkai's own breach of a non-excludable duty or other conduct for which liability cannot lawfully be excluded caused or contributed to the loss.

Availability and third-party services

Terkai does not guarantee uninterrupted access, error-free operation, successful email delivery, or indefinite availability of stored plans.

To the maximum extent permitted by law, the Terkai parties are not responsible for failures caused by events outside their reasonable control or by independent third-party services that they do not direct or control.

Nothing in this paragraph excludes responsibilities imposed on Terkai by applicable law in relation to its own selection or use of service providers or its handling of personal information.

Indirect and business losses

Terkai is intended for personal use.

To the maximum extent permitted by law, the Terkai parties are not liable for business losses, including loss of revenue, profits, business opportunities, or anticipated savings, arising from use of the service.

Any exclusion of indirect or consequential loss applies only to the extent permitted by law and does not restrict any statutory right to compensation that cannot lawfully be excluded.

Liability that cannot be excluded

Nothing in these terms excludes or limits liability where doing so would be unlawful.

In particular, these terms do not exclude liability for fraud, deliberate wrongdoing, gross negligence where it cannot lawfully be excluded, or any statutory guarantee, duty, right, or remedy that applicable law requires to remain available.

8. Email and personal information

Emails about accessing your plan are service messages. Joining the product waitlist is a separate, optional choice. Agreeing to these terms or opening a plan does not subscribe you to marketing.

The service uses your selections, generated plan, email address, and browser access information to provide and recover your plan. Contact messages and optional waitlist requests are separate records. For questions about your information or a deletion request, contact admin@terkai.com. Verification may be needed to protect your information.

A separate privacy notice describing the live service’s providers, retention, and handling of personal information must be finalized before public launch. This section is not a substitute for that notice.

9. Changes to these terms

The terms version and acceptance timestamp are recorded when you first open a plan. Material changes require acceptance before opening a new plan. Changes do not retrospectively remove rights attached to an existing plan.

If a provision is unenforceable, the remaining provisions continue only to the extent they can lawfully operate without it.

10. Contact and unresolved launch details

Terkai is the service name. Questions, complaints, and concerns about a plan can be sent to admin@terkai.com. You retain the right to seek assistance from a relevant consumer authority or court.

The provider’s legal identity and location have not yet been confirmed for this draft. No company registration, governing-law jurisdiction, or exclusive court location is asserted here. These details require confirmation and legal review before publication as final terms.
